The Franklin Jazz Festival is the 22nd annual fall festival produced by Zia Music Production, LLC. The festival consistently has been listed by the Southeast Tourism Society as not only being one of the longest running but also one of the top Jazz Festivals in the Southeast. Its purposes are to showcase high quality superb musical entertainment, acquaint the public with the restored historic downtown area, and raise money for this years non-profit beneficiarie, The GEAR Foundation. The 2010 festival drew an estimated 8,000 people for the two-day event. Additions to this year’s event include a larger “Jazz Café” (beer and wine tent) in site of the Main Stage. Live music on the stage in the “Jazz Café” is between acts on the Main Stage so that there is continuous live music during the entire event. The gates will open at 4pm with music beginning in the “Jazz Café” at 5:15 and on the Main Stage at 6pm. The Headliner on both days comes on at 8:30. The event ends at 10pm. 8 groups total will partake in the two days.

Note: Check must be mailed and received before acceptance is complete.
1. There are absolutely no refunds once fees are paid for any reason. By signing this contract the vendor agrees to pay the specified booth rental fee of $300 for a 10x10 space or $500 for a 10x20 space. Any cancellation will result in a forfeiture of all fees paid. Please submit one check for all fees, (not including the damage deposit) if not accepted monies will be refunded less the application fee. All fees and positioning will be handled on a first come first served basis after the initial deadline has past.
All checks should be made payable to: Franklin Jazz Festival. Application deadline is August 20, 2011.
2. Returning vendors will have priority until July 25th 2011. At that time all vendors will be considered on a first come first served basis and product.
3. All vendors will pay a separate $100 damage deposit check that will be returned after the festival is complete and the vendor has been checked out to make sure the site is left clean and deemed acceptable by management and The City of Franklin.
4. Vendor agrees to submit a certificate of insurance with a minimum of $1,000,000 (one million dollars) insurance liability coverage and listing: Zia Music Production, The City of Franklin, Brightstone and The GEAR Foundation as additional insured under their policy. Vendors will not be allowed to participate in the event if insurance has not been
received by August 15, 2010 and will forfeit all fees paid to that point.
5. Vendor agrees to indemnify and hold harmless: Zia Music Production, LLC, The City of Franklin, and The GEAR Foundation against any claim or action for any cause. Vendor agrees that they will be responsible for their own insurance under this hold harmless clause, which is made a part of this contract.
6. Vendor will submit a complete menu to include prices of items to be sold at this event. It is understood that booth spaces will not be allocated until menu and all other requested information is received.
7. Vendor understands that it is their responsibility to provide their booth, tent, trailer, etc. If utilizing a tent, application must include a copy of the Flame Spread Certificate and must meet the basic requirement of NFP 701. In addition,
Vendor agrees to adhere to all Health and Fire Department regulations related to booth setup and proper food preparation and service. Vendor understands that the Health and/or Fire Department will close their operation and vendor will forfeit all fees paid under this agreement if standardsare not adhered to.
8. Vendor understands that it is their responsibility to obtain a Propane Permit from the Franklin FireMarshall’s Office prior to setting up for the event if applicable.
9. Vendors will be allowed to sell soda and water for an additional fee as specified below. Any other beverages will be approved on a case by case basis. Any violation of this policy will result in immediate termination of this contract and forfeiture of all paid fees.
10. Vendor understands that the Franklin Jazz Festival name and logo are restricted trademarks. As such, any use of these is strictly prohibited without written consent from Zia Music Production, LLC .
11. No smoking paraphernalia or any items deemed inappropriate or illegal by the State of Tennessee may be sold.
12. Tennessee State sales tax will be the sole responsibility of the vendor.
13. It is understood that submission of my application and menu does not guarantee a spot at this event. The Franklin Jazz Festival will notify vendor either via email of their acceptance and approved menu. Attempts to sell any other items not on the pre approval letter will result in termination of this agreement and the forfeiture of any and all fees paid.
14. Vendor understands that if a major sponsor is designated then Vendor may be required to use that named product.
15. Vendor understands that they will be fined a minimum of $500 for not disposing of waste properly in provided dumpsters and grease traps. Vendor understands that tree wells are not to be used as trash or waste receptacles.
16. Any violation of this agreement will permit the immediate termination of this agreement.
17. I understand that I am responsible for my employees and will ensure that their actions reflect favorably on the Franklin Jazz Festival, The City of Franklin, the GEAR Foundation and their Board and employees.
18. I understand that if I cancel my participation in this event all monies I have paid will be forfeited except for the clean up deposit.
